Mediation is a
negotiation facilitated
by a trained third party
neutral who helps the
parties reach decisions.
The mediator has no
decision-making power
but assists the parties
to a dispute to
voluntarily reach
mutually acceptable
settlement of disputed
issues.
Mediation can be used
when earlier attempts at
resolution have failed.
Because the mediator is
not a person directly
involved in the dispute,
the mediator can help
the parties fully
explore the facts of the
case and think about new
settlement options.
Neutral persons
often provide parties
with new perspectives on
the issues that divide
them. Emotions can
become intense and
prevent settlement.
Parties can find
themselves too attached
to their positions that
can prevent them from
seeing all options
